FundSocial Terms and Conditions

These Terms govern access to and use of the FundSocial platform, including user accounts, events, social clubs, wallet balances, contribution flows, recurring payments, withdrawals, support channels, and related website or mobile app functionality.

1. Acceptance and eligibility

By creating an account, accessing FundSocial, or using any part of the service, you agree to be bound by these Terms and by the FundSocial Privacy Policy. You must be at least 18 years old and legally capable of entering into binding agreements. If you use FundSocial on behalf of a group, club, or other organisation, you confirm that you have authority to act for that group.

2. What FundSocial does

FundSocial provides software that helps people create and administer events, social clubs, contribution requests, internal wallet balances, payment flows, and communication activity. FundSocial is a technology platform and facilitator. FundSocial is not a bank, trustee, escrow provider, insurer, fiduciary, financial adviser, or guarantor of any user, event, club, organiser, contribution target, or outcome.

FundSocial may use third-party service providers, including payment processors, identity or fraud tools, cloud infrastructure providers, messaging providers, and analytics tools, to operate the service.

4. Events, clubs, and organiser responsibility

Users who create or manage events, clubs, campaigns, or other collective funding activity are solely responsible for the accuracy, legitimacy, legality, and fulfilment of those activities. Organisers must not mislead participants about the purpose of funds, expected use of funds, withdrawal timing, refund rights, or who controls the account.

FundSocial does not verify every organiser, event, or social club and does not guarantee that any organiser is honest, solvent, compliant, or capable of delivering promised outcomes. Participants contribute at their own risk, subject to any non-excludable rights under law.

5. Fraud, misuse, and best-efforts moderation

FundSocial may monitor platform activity, investigate suspicious conduct, freeze access, place holds on withdrawals, request additional information, reverse internal credits where permitted, and cooperate with payment providers, banks, law enforcement, regulators, or affected users where fraud, scams, impersonation, chargeback abuse, stolen payment credentials, account compromise, prohibited conduct, or material misrepresentation is suspected.

FundSocial will use reasonable commercial efforts to detect and respond to suspected misuse, but FundSocial does not promise that all fraudulent or harmful conduct will be prevented, identified, or resolved before loss occurs. To the maximum extent permitted by law, FundSocial is not liable for losses caused by organiser fraud, user deception, hacked accounts, or misuse by third parties unless caused by FundSocial's own breach of non-excludable legal obligations.

6. Payments, wallets, and platform balances

Wallet balances shown in FundSocial are platform ledger balances only. They are not deposit accounts, savings accounts, stored-value accounts regulated as bank accounts, or trust accounts unless FundSocial explicitly states otherwise in writing. A displayed wallet balance represents an internal record of value available for permitted in-platform use or withdrawal processing, subject to holds, pending settlement, reversals, disputes, fees, compliance checks, and technical errors.

Funding

Wallet funding may occur through cards, bank debit methods, recurring charges, refunds, event transfers, or other supported rails. Availability of funds may be delayed pending settlement, fraud review, processor confirmation, or dispute windows.

Withdrawals

Withdrawals are requests, not guarantees of immediate payout. FundSocial may delay, batch, hold, reject, or cancel withdrawals where needed for fraud review, compliance, settlement risk, processor limitations, sanctions screening, identity verification, or technical reconciliation.

7. Payment processors and third parties

Payment processing is provided through third parties, including Stripe and connected financial institutions. By using paid features, you also agree to any applicable processor terms and acknowledge that processor approvals, settlement timing, payment method availability, and payout capabilities may change independently of FundSocial.

FundSocial is not responsible for processor downtime, payment network failures, banking delays, card issuer decisions, chargebacks initiated by cardholders, or third-party refusals to process payments.

8. Fees, charges, and fee changes

FundSocial may charge platform fees, withdrawal fees, top-up fees, event-related fees, refund-related fees, processing pass-through costs, foreign exchange costs, and other disclosed charges connected with use of the service. Fees may be charged to organisers, contributors, recipients, or withdrawing users depending on the transaction type.

9. Recurring charges and saved payment methods

If you enable recurring top-ups, saved payment methods, or other off-session charging features, you authorise FundSocial and its payment providers to store and use the relevant mandate or tokenised payment credentials for future charges in accordance with your settings and these Terms. You are responsible for ensuring your payment method remains valid and funded.

10. Holds, reversals, negative balances, and set-off

FundSocial may place holds on balances, reverse internal credits, offset amounts, or create negative balances where transactions fail, are disputed, are reversed by a processor, are associated with fraud or error, or must be corrected due to pricing, settlement, or ledger issues. You authorise FundSocial to recover amounts owed by deducting from future inflows, wallet balances, payouts, refunds, or other amounts otherwise payable to you, subject to law.

11. Refunds, disputes, and participant complaints

Refund availability depends on the product flow, event settings, withdrawal status, processor rules, applicable law, and platform policies. FundSocial may offer tools to request or administer refunds, but FundSocial does not guarantee that a refund will be available in every case. Where a dispute arises between organiser and participant, FundSocial may investigate, request evidence, freeze balances, or facilitate communication, but is not obliged to adjudicate every dispute or reimburse losses from its own funds.

13. Suspension, restriction, and termination

FundSocial may suspend or terminate any user, event, club, listing, payment flow, or withdrawal capability immediately where reasonably necessary to protect users, investigate misconduct, comply with law, satisfy processor requirements, manage risk, or prevent loss. Termination does not remove obligations that accrued before termination.

14. Intellectual property and licence

FundSocial and its related branding, software, interfaces, workflows, and content are owned by FundSocial or its licensors. Subject to these Terms, FundSocial grants you a limited, revocable, non-exclusive, non-transferable licence to use the service for its intended purpose.

15. Indemnity

You indemnify FundSocial, its operator, affiliates, contractors, and service providers against claims, losses, liabilities, costs, and expenses arising from your use of the service, your breach of these Terms, your event or club activity, your misuse of payments, your violation of law, or your infringement of another person's rights, except to the extent caused by FundSocial's own unlawful conduct.

16. Liability limits

To the maximum extent permitted by law, FundSocial excludes liability for indirect, incidental, special, consequential, punitive, or exemplary damages, loss of profits, loss of reputation, loss of opportunity, loss of data, or losses caused by third-party conduct, processor failures, chargebacks, organiser fraud, or service interruptions. Where liability cannot be excluded, it is limited to the minimum extent permitted by law.

Nothing in these Terms excludes rights you may have under the Australian Consumer Law or other non-excludable laws. If a consumer guarantee applies, FundSocial's liability is limited, where permitted, to resupply of the relevant services or payment of the cost of resupply.

17. Changes to the service or Terms

FundSocial may change, add, remove, or discontinue features, transaction limits, workflow rules, verification requirements, fees, supported payment methods, or these Terms at any time. Updated Terms take effect when posted unless a later date is stated. Continued use after an update constitutes acceptance of the revised Terms.

18. Governing law and contact

These Terms are governed by the laws of New South Wales, Australia, unless mandatory law requires otherwise. You submit to the non-exclusive jurisdiction of the courts of New South Wales and Australia.

Legal and privacy notices may be sent through the contact channels published on FundSocial. Until dedicated mailbox infrastructure is finalised, support and legal contact may also be initiated through in-app support channels or website-published contact details.
